ABSTRACT
Prison Maximum sentences are generally laid down by legislation, but in most cases the courts have discretion over what sentence actually to impose. However, there is a mandatory life sentence for murder, and courts are required to impose an automatic life sentence on an offender committing a second serious violent or sexual offence unless there are exceptional circumstances.
