Whichever type of term is broken, the innocent party is entitled to damages.
If the term broken is a condition, the innocent party is entitled to regard the contract as repudiated by the guilty party.
If the term broken is a condition and the innocent party is the buyer, the buyer is entitled to reject the goods and recover any of the price already paid.
