ABSTRACT

Meaning of judicial review Section 31 of the Supreme Court Act (SCA) 1981 and Part 54 of the Civil Procedure Rules (CPR) 1998 provide the rules applicable to judicial review. Applications for judicial review are heard by the Administrative Court, a subdivision of the Queen’s Bench Division of the High Court, staffed by judges experienced in this type of claim. The powers of review are only available against public bodies in relation to their public functions and a claim can only be brought by a person with ‘sufficient interest’ in the matter (s 31(3) of the SCA 1981).
