ABSTRACT

Where a business supplies a service to a consumer, there is an implied term in the contract that the service will be performed with reasonable care and skill. This means that the plumber must be sufficiently skilled as a plumber, or that your dentist must demonstrate the standard of care of a reasonable dentist. So, if your plumber forgot to turn the water off before he started work and your kitchen was flooded, or the filling your dentist inserted came out an hour later, you could sue for breach of contract.
