ABSTRACT
This is a fairly typical problem question dealing with issues which arise mainly, but not entirely, under the Public Order Act (POA) 1986 in respect of marches and assemblies. It also requires an awareness of the provisions of Arts 10 and 11 as interpreted at Strasbourg, and of their potential impact on UK law under the HRA 1998. If any of the statutory provisions considered leave open any room at all for a different interpretation (not only on the grounds of ambiguity), they should be interpreted in harmony with Arts 10 and 11 of the European Convention on Human Rights (ECHR).
