ABSTRACT

Section 265 of the Insolvency Act 1986 provides that a bankruptcy petition can only be presented by a creditor or the debtor where the debtor is either domiciled in England or Wales, personally present in England or Wales on the day on which the petition is presented or, during the previous three years, has either been resident or carried on business in England and Wales.7
