ABSTRACT
However, Australian courts are sometimes willing to allow the court’s factfinding function to be diverted by the need to judge the process that led to the evidence being available in court. This chapter examines how evidence law balances the immediate goal of promoting accurate fact-finding against the broader goal of promoting legitimate investigations.
