Court (1989): Objective test for indecency Facts The defendant worked in a shop. He asked a 12 year old girl who visited the shop whether she would let him spank her. She said ‘No’ but D seized her and spanked her repeatedly on her backside. When arrested by the police, D admitted to spanking her and, when asked why he had done so, he replied ‘I don’t know, buttock fetish’.
