ABSTRACT
Introduction Defences relating to the defendant’s mental disorder rest on the assumption that a person should only be convicted on the basis of acts voluntarily committed, and that the mental disorder (providing it fits within the requisite definition) rendered the defendant unable to act voluntarily. In this sense defences of mental disorder negative the mens rea of any offence and are therefore justificatory.
