ABSTRACT

In this chapter, we move on from the broader issues raised in the last chapter to consider specific issues which have been tested before the courts in relation to negotiations leading up to an offer. The chapter which follows on from this moves on to look at problems which have arisen in relation to acceptance. Although they have been separated out in the interest of introducing topics in an accessible and manageable format, these chapters should be read together as there is considerable overlap. Despite the tendency to aspire to clear, if somewhat illogical, rules to govern the law relating to offer and acceptance, in practice it is often difficult to separate the two concepts out.
