ABSTRACT

Prior to 1995, there was a single General Development Order, the content of which was effectively split into two parts by the introduction of the Town and Country Planning Order (GPDO) 1995 (SI 1995/418) and the Town and Country Planning Order (GDPO) 1995 (SI 1995/419). These orders are applicable to all land in England and Wales. The 'sections' comprising these Orders are referred to as 'Articles'. Permitted development is defined in Sched 2 of the GDPO, which provides details of development which can be undertaken without the need to seek planning permission. Section 40 of the Planning and Compulsory Purchase Act (PCPA) 2004, allows local planning authorities (lpas) to expand the national permitted development rights by making a local development order (LDO) to implement policies in one or more of the development plan documents prepared under Part 2 of the 2004 Act, or in any local development plan.
