ABSTRACT

This chapter explores all references relate to the Planning Listed Buildings and Conservation Areas Act (LBCAA) 1990 and the Planning Listed Buildings and Conservation Areas Regulations 1990. It is stressed that the listing of a building extends control over activities which would otherwise be exempt from control under s 55 of the Town and Country Planning Act (TCPA) 1990. Listing requires consent for the demolition of a listed building, or its alteration or extension in any manner likely to affect its character as a building of architectural or historic interest. The listing of a building at a date after the granting of an extant planning permission does not invalidate the need to seek listed building consent for works yet to be completed. The Ecclesiastical Exemption Order 1994 provides exemption for buildings of the Church of England, the Baptist Union of Wales and the United Reformed Church and university chapels, Church of Scotland, Free Church of Scotland and Free Presbyterian Church.
