If we think mediation is a good thing, where do we start? How do we get others to agree to mediate? How do we find the right mediator? What if the disputants do not agree on their choice of mediator? Should there be one mediator or two? How do we check for conflicts of interest? What documents are signed before the mediation and what do they say? How much written material should a mediator get before the mediation? How should disputants and lawyers prepare for mediation? Who should attend the mediation? Should the disputants meet privately with the mediator before the mediation begins? What about the logistics – who books the rooms, arranges for food?
