A guarantor will only be liable under the guarantee to pay the rent due under the tenancy and not for any interim rent, unless the guarantee clearly provides for this (Junction Estates v Cope (1974) 27 P & CR 482; A Plesser and Co v Davis [1983] 2 EGLR 70).

The tenant’s right to remove tenant’s fixtures continues during the continuation tenancy (New Zealand Government Property Corporation v HM & S Ltd [1982] 1 All ER 624, CA). The tenant is also entitled to continue to use the landlord’s fixtures (Poster v Slough Estates Ltd [1968] 3 All ER 257).
