ABSTRACT

If the recipient of a s 40 notice has transferred his interest in the premises or any part of them to someone else and gives written notice of this transfer to the person who served the s 40 notice, together with the name and address of the transferee, then he ceases in relation to the premises or (as the case may be) to that part to be under any duty imposed by s 40 of the 1954 Act (s 40A(1) of the 1954 Act). In other words, he will no longer have to update information, provided he has given the appropriate notice to the person who served the s 40 notice.
