ABSTRACT

The effect of this provision is to continue the tenancy automatically for three months after the application has been finally disposed of. This will be the case even if the application for a new tenancy has been made outside the time limits laid down by the 1954 Act, as these time limits are procedural and can be waived (Zenith Investments (Torquay) Ltd v Kammins Ballrooms Co Ltd (No 2) [1971] 3 All ER 1281, CA). Where an application is made by someone who is no longer the tenant, s 64 of the 1954 Act will not continue the tenancy (Meah v Sector Properties Ltd [1974] 1 All ER 1074, CA).
