In order to rely successfully on ground (e), a landlord will need to prove its title to the premises, together with the creation of the superior tenancy and the sub-tenancy. Expert evidence will then be required to prove the rental issues mentioned in 8.5.2, and also to prove the landlord’s intention to let or dispose of the property as a whole.
