ABSTRACT

Where the landlord’s interest belongs to or is held for the purposes of a government department the landlord can validly agree with the tenant that if the minister or board in charge of the department issues a certificate that for reasons of national security it is necessary that the use or occupation of the property should be discontinued or changed, the tenancy may be terminated by notice to quit given by the landlord of such length as may be specified in the agreement, provided the notice contains a copy of the certificate (s 58(2) of the 1954 Act). It may also be agreed that, after the giving of such a notice containing the copy certificate, the tenancy shall not be one to which the 1954 Act applies (s 58(2) of the 1954 Act).
