Although there is an offence of causing death by careless driving while under the influence of alcohol or drugs, a fatality which results from careless driving in other circumstances is treated as an aggravating factor in a ‘careless driving’ charge. Careless driving comprises two kinds of offence: ‘driving without due care and attention’ and ‘driving without reasonable consideration for other road users’. The key difference is that the latter requires evidence that some other road user was actually inconvenienced. In practice, these two offences are both referred to as ‘careless driving’.
