ABSTRACT
Once a duty of care has been established, the next hurdle faced by the victim is to show that the defendant has acted in a way which is in breach of that duty. In order to do this, it is essential that there be some mechanism to decide the standard of behaviour which can be expected from the defendant. The conduct of the claimant may also be relevant; this will be considered in the later chapter on defences.
