ABSTRACT

The second part of the book is introduced by exploring comparative case studies in two jurisdictions, England and Italy. It is not presented in any way as the definitive individual analysis of trial processes from the chosen jurisdictions. To attempt or even to represent this would distort the significance of these jurisdictions as a foundation for comparative contextual analysis (CCA) preceding projections on the transformation of international criminal justice (ICJ). Nor (as we say in Chapter 3) are the narrative data held out as being sufficient for a total comparative analysis of trial process in context (jurisdiction to jurisdiction, local to global). Rather, this is an opportunity to suggest from limited but no less provocative research terrain, the extent to which satisfying comparison is possible, and to develop insights for internationalization.
