ABSTRACT

This chapter identifies the relevant measure of care applicable to non-professionals and professionals and explains the general standard of care. It explores the standard of care applicable to professionals, particularly doctors. The chapter discusses the factors used in determining whether a defendant has fallens the standard of care appropriate to the duty owed. It analyses the concepts of standard of care and breach of duty of care and also identifies the appropriate standard of care in factual situations. The chapter describes the factors for determining breach to factual situations in order to establish if a breach has occurred. Breach of duty, the second element of negligence, actually refers to the standard of care that is appropriate to the duty owed. The duty of care owed to a disabled participant in sporting events will be greater than that owed to an able-bodied sportsman, simply because the disability will require a greater degree of care.
