ABSTRACT

The imbalance of understanding between the text (naṣṣ) and the context causes Islamic legal products to become rigid, extreme, and radical. Uṣūl al-fiqh is one way to present Islamic law that is flexible, humanist, and in accordance with the needs of the times. This paper aims to revitalize uṣūl al-fiqh through the iḥtiyāṭī principle as the main method for finding moderate Islamic law. This article uses descriptive-qualitative method with library data. This paper finds two main factors in revitalizing uṣūl al-fiqh. First, the existence of the iḥtiyāṭī principle in the three uṣūl al-fiqh frameworks, namely 1) a balance of thinking patterns, 2) process flexibility, and 3) a holistic approach. Second, the existence of the iḥtiyāṭī principle in the source of the law. These two factors are strong indicators that uṣūl al-fiqh is the right method to realize benefit. The authors suggest to further researchers to examine uṣūl al-fiqh, especially regarding the iḥtiyātī principle in other sources of law.
