ABSTRACT
This study is normative legal research that employs both conceptual and case study approaches. This research aims to determine the legal status, offer solutions, and address legal issues related to intellectual property rights, specifically, copyright (Hak Kekayaan Intelektual or HKI) acquired during the marriage. The findings conclude that moral rights to a copyrighted work remain exclusively with the creator, even if the work was produced during the marriage. However, the economic rights to the copyrighted work are considered joint property if created during the marriage, regardless of whether the marriage has ended. Consequently, both spouses are entitled to royalties from copyrighted works produced during marriage. This conclusion aligns with the legal ruling in the division of joint property in the case between Virgoun, a musician, and Inara Rusli, a social media influencer.
