While various legal texts aiming at providing a framework for AI are under discussion, a more flexible approach, involving the use of ethics in order to choose whether or not to deploy an AI project, appears particularly relevant. This article presents how such an approach is considered in France, through the recommendations of France’s highest administrative court, as well as the difficulties faced by public actors in applying them at local level. It will also be shown how the think and do tank Ekitia created tools – including an Ethical Charter and a Label – to make actionable the reflection conducted towards the deployment of ethical AI for actors concerned.
