ABSTRACT
The boom in Information Technological sector has paved way for digitization of almost everything globally. One such burning example is that of electronic contracts. Through this paper the author takes into consideration the various factors, challenges and outcomes which circumspect the e-contracts enforceability in India. The statutory enactments like Bhartiya Sakshya Adhiniyam,2023; The Contract and the I.T. Act intertwined together forms very basis of electronic contracts in India. Through this paper precedents upholding the validation and enforcement of digital signatures and contracts electronically signed have been cited. The research paper also delves into the challenges posed while making use of electronic contracts in India including but not limited to jurisdiction conflicts, competency of parties virtually and veracity of existing cyber security laws. Through this paper the emphasis has been laid down on taking effective steps to overcome these challenges through awareness programmes, legislative reforms and robust security. The paper concludes signifying the need of research and development for developing an ecosystem of trust, safety and security in digital world.
