ABSTRACT

The present era is marked by rapid technological advancements which have a major significance in almost all the spheres. It has special significance in legal field especially under criminal justice system. The application of technology in law has various facets especially in the form of forensic evidence. It is seen that forensic evidence plays a crucial role in determining the guilt of accused. The failure to analyse the evidence properly by the Forensics may lead to miscarriage of justice to the victim. Even it is an active step towards speedy investigation of cases by the police officers. This importance has been incorporated under Section 176 of BNSS, 2023 which makes mandatory provision for the collection of forensic evidence.

It is seen that the Artificial Intelligence (AI) is revolutionizing day by day and is being widely used in medical scientific experiments for accuracy and efficiency. The technological growth has led to greater impact of AI in Forensics as well. It helps in identification of the accused through various other evidences. Scientific experiments assist in confirming the actual perpetrator of the crime through DNA tests, fingerprints scan, handwriting detection, facial recognition and extraction of information through electronic devices (digital forensics).

Although the AI has positive impact upon the criminal investigation but it's negative impact could not be looked away. The fact that there exists difference between human and machine could not be denied. Since AI is machine programmed, it has the chance of being misappropriated through fabrication of false evidences. Therefore, there exists need of certain ethical standard guidelines for the regulation of AI in forensic analysis.
