ABSTRACT
The modern digital era witnesses massive use of personal data in all areas which is why it must be protected through data protection laws. The challenge increases more so with the advent of Artificial Intelligence. The present research paper explores the contours of data protection laws vis a vis Artificial Intelligence by undertaking an analysis of data protection mechanisms available under General Data Protection Regulation (GDPR) of European Union and provincial laws of United States of America with focused approach towards the possible application of these data protection laws to Artificial Intelligence (AI). The newly enacted Digital Personal Data Protection Act 2023 of India also extends to the labyrinth of data protection and emerging domain of AI. The paper recommends dynamic regulatory approaches focusing on values - based AI regulation to future - proof data protection in India and internationally.
