ABSTRACT

Indigenous rights to resources in Australia, Canada, New Zealand and other jurisdictions have been major domestic issues over the past thirty years. The leading judicial decisions have dealt with land rights. Additionally, there are important decisions on hunting and fishing. Very recently, cases and settlements have dealt with rights to rivers, lakes, foreshore and offshore.1 No significant decision on indigenous rights in the field of aquaculture has occurred, though there has been some activity on the issue in Canada and New Zealand. Any indigenous claims in relation to aquaculture would build on the judicial rulings on land, fish and water.
