ABSTRACT

The chapter provides an overview of Polish maritime safety and security legislation. Polish regulation on maritime safety and security are settled outside the Maritime Code. As a Member of the EU as well as the International Maritime Organization, Poland follows most of the EU and international safety standards. This chapter aims at analysing the issues most challenging for the Polish legislator, as well as assessing the strengths and weaknesses of the Polish regulations. The authors analysed not only the preventive rules dealing with maritime safety, security and marine environment protection but also the way they are enforced within the Polish legal system, mainly by the administration and penal sanctions. Also, the liability issues are discussed. Analyses are considerate in a broader, systematic context of the Polish methods of incorporation of international treaties.
