ABSTRACT
This chapter analyses the action of the European Union (EU) – in particular the Code of Practice on Disinformation – and its limits. It focuses on the issue of the privatisation of censorship, which is taken to mean the delegation of powers to private actors in a field as important as that of fundamental rights. The chapter summarises the limits of the EU action and focuses on the development of some forms of control over the actions of the Internet platforms. The Code of Practice on Disinformation is a good attempt to give Internet platforms responsibility, to force them to attempt to counter the spread of fake news, and to rebuild the role of journalism on the Internet, with the intention of preserving the role of the press – in a broad sense – in European democracies.
