ABSTRACT

The issue of judicial accountability relates to a number of concepts. The authors believe that the term ‘accountability’ in relation to the judiciary seems to be quite elastic and inclusive. However, in this chapter, the authors focus on disciplinary liability of judges. By disciplinary liability, the authors understand certain measures to hold judges accountable for unlawful acts (that are not common offenses) or judicial ethics, which are not subject to appeal in the judiciary due course of instance. The authors discuss in detail the solutions functioning presently in Poland after several legal amendments introduced by the Law and Justice Party in the years 2015–2020. The authors argue that new measures concerning judges’ disciplinary liability fail to achieve greater judicial transparency; on the contrary, they serve as a tool of intimidation.
