ABSTRACT

India has a longstanding culture of compassion towards other living beings. The principle of protection of animals is enshrined in the Constitution of India and the constitution places a duty on the citizens to show compassion for all living beings. This chapter aims to briefly summarise the relevant central animal protection laws in India to provide an overview of the legal framework for animal protection in India. Although animal protection law in India is fairly expansive lacunae, low penalties and issues with enforcement continue to impact animal welfare and protection. This chapter starts by laying the constitutional framework that supports animal protection and welfare in India. It covers the laws specifically relating to animal cruelty with special emphasis on the Prevention of Cruelty to Animals Act, 1960, which applies to all animals in India and rules framed thereunder. Lastly this chapter analyses the central legislation relating to the welfare of farmed animals, companion animals, wild animals, animals used for scientific or educational purposes, and performing animals.
