ABSTRACT

The final chapter provides some insight as to what rules and practices serve and safeguard the legitimate interests of the victims of miscarriages of justice. It uses a country-by-country analysis to compare the substantive and procedural aspects of national legal frameworks regarding compensation for wrongful conviction. It offers a global view on similarities and differences between the investigated legal systems as well as identifiable trends regarding the compensation for wrongful conviction. In this consideration special emphasis is placed on the accessibility and effectiveness of the existing compensation schemes. The chapter aims to identify the optimal shape of provisions regarding compensation for wrongful conviction which may maximize the remedial effect for the victims of miscarriages of justice.
