ABSTRACT

Aotearoa New Zealand’s legal system is based on Anglo-Saxon/English common law. The current legal framework primarily comprises the Constitution Act, 1986, the principles of the Treaty of Waitangi 1840, the New Zealand Bill of Rights Act 1990, and the Human Rights Act 1993 (Constitution Act, 1986; Treaty of Waitangi, 1840; New Zealand Bill of Rights Act 1990; Human Rights Act 1993). Based on an adversarial model, the court system comprises the Supreme Court (highest authority), the Court of Appeal, the High Court, and the District Court. Specialist courts within the District Court include the New Beginnings Court and the Special Circumstances Court for homeless individuals, the Alcohol and Other Drug Treatment Court, and the Youth Court. Since 2020, the District Court in Auckland has held dedicated hearings for defendants with potential mental health issues, improving justice access for vulnerable individuals. However, specialist courts are not universally available, limiting access for some defendants.
