ABSTRACT
This chapter will explore the relationship between the criminal justice system and human rights in Indonesia. It first outlines international scholarship on the relationship between criminal law and human rights. It then discusses the development of Indonesian criminal law, focusing on how human rights have influenced the legal framework. There is particular emphasis on four aspects: namely, regulation of criminal acts, criminal procedures, sentencing, and protection and rights of the victims. The chapter analyses both substantive and procedural aspects of criminal law, as well as legal practice. This structure is chosen to provide a comprehensive picture of the integration of human rights into the field of criminal law. While the chapter identifies many shortcomings in how human rights are protected within the criminal justice system, it also shows that human rights have significantly impacted how the legal framework has developed.
