ABSTRACT

Article 12 of the CRPD referring to equality before the law, introduces specific standards of protection of persons with disabilities and guarantees of implementation thereof. It should be underlined that the Committee on the Rights of Persons with Disabilities, appointed in compliance with Article 34 of the CRPD, in a Comment to Article 12 of the CRPD, recognised the right to equal treatment as generally binding; therefore, it is not possible to limit this right. The first standard resulting from Article 12 of the CRPD is the right of persons with disabilities to recognition of as persons before the law. The third standard resulting from Article 12 of the CRPD is the obligation of states parties to take appropriate measures to provide persons with disabilities with access to the support they may require in exercising their legal capacity.
