ABSTRACT
This chapter analyses the evolving case law of the Inter-American Court of Human Rights regarding Indigenous Peoples’ consultation rights in Latin America. Drawing on practical experience and case law, the authors examine how judicial interpretations have shaped and limited the implementation of international standards, emphasising the need for stronger agency and participation of Indigenous communities.
