ABSTRACT

There is a growing trend towards consolidating criminal justice reforms and adopting best practices at national and continental levels. With an emphasis on the South African experience, this chapter establishes the importance of non-custodial sentences. It then evaluates the normative guidance on non-custodial sentences in international and national law. At its core, the chapter deciphers the forms of non-custodial sentences in the context of both adults and minors. A conclusion and recommendations on these nuances follow.
