ABSTRACT
This chapter focuses on the working of the principle of proportionality on fines imposed for violations of the General Data Protection Regulation in a particular case adjudicated at the national (Polish) level. It elaborates on the interpretation and application of the aggravating and mitigating factors incorporated into this regulation's fining provisions. It also analyzes the (dis)respect for the standard of protection provided for by Article 47 of the Charter of Fundamental Rights of the European Union and the consequences of the data protection authority's failure to sufficiently justify its fining decision.
