ABSTRACT
This monograph is the result of a deliberate response to the growing prevalence of environmental and climate-related hazards, both within and beyond national borders, as well as the underlying economic and geopolitical tensions affecting the Member States of the EU and the broader international community. These developments provided the impetus for the research initiative undertaken in 2022 at the Jagiellonian University by scholars affiliated with the Chair of European Law and the Department of Environmental Law. Following an international seminar entitled “Cross-border pollution in EU law – searching for remedies” which took place in March 2022 at the Jagiellonian University, a project of the book covering both the substantive and procedural aspects of the inter-States environmental disputes was conceptualized. The project brought together a diverse group of scholars from multiple Member States, each representing distinct areas of legal expertise, including EU constitutional law, EU and national environmental law, EU corporate governance, EU private international law, mediation law, and international investment law within the framework of public international law.
