ABSTRACT
The issues at stake discussed in this chapter are interesting at least for two reasons. The first reason is the cross-border dispute between the Republic of Poland and the Czech Republic. In the proceedings before the Court of Justice of the EU (CJEU), the interim order largely took into account the position of the Czech government. The second reason why the analysed problem is important is related to the transboundary environmental impact, in which national legislation must also be taken into account. It follows from the analysis of the arguments of the parties that the applicant's arguments were founded owing to the violations of the Polish law by the Polish authorities responsible for environmental impact assessment procedures.
