ABSTRACT

This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book explores the various national understandings and practices of effective legal protection in administrative law. It provides the principle of effective legal protection, another fundamental principle of administrative law. The book examines if there are general trends in the development and the application of this principle. It explores the use of certain standard elements and, as far as it was possible, similar methodology in describing and analysing the national situations. The book provides a conceptualisation of the principle of effective legal protection in administrative law, defines core issues and elaborates the conceptual framework of our research. It analyses this principle on a European level, mainly in the jurisprudence of international/European courts. The book focuses on a research project of the Institute for Legal Studies of the Hungarian Academy of Sciences, and was partially financed by the National University of Public Service, Budapest.
