ABSTRACT
This chapter deals with the Italian Corte di cassazione during the German occupation in World War II. It is explained how the creation of the puppet state of the Italian Social Republic in 1943 – a reaction to the allied advances in the south – necessitated the relocation of the court from Rome to northern Italy. The influence of Nazism and fascism on its case law and the issue ofits political reliability are considered, as well as the role of Justice minister Pisenti.
