ABSTRACT

Pancasila is the basis of all sources of law in Indonesia. Pancasila’s philosophy should be reflected in the legislation-making process in Indonesia, which includes the system of appointing public officials. The system and mechanisms of staffing and appointment of public officials still have weaknesses and issues, in terms of both the concept of institutional structures, and the culture and character of individual public officials in Indonesia. The problems of decadency in structural, personal and cultural standards occur at almost all levels of public officials in Indonesia; therefore, the implementation of the values and principles of Pancasila are drifting further away from the ideals and expectations of the nation. The deterioration of morals among public officials and the organisational culture have an adverse effect on the function of good governance, and this is due to the non-implementation of Pancasila values in the recruitment system of public officials in Indonesia. This study uses normative legal research and sociological methods in order to devise a better recruitment system of public officials, one in accordance with the values and principles of a state of law of Pancasila.
