ABSTRACT

The adoption process can be conducted within the national jurisdiction of a state, or by request of foreign citizens outside the territory of the state. The first type is referred to as local adoption, while the second type is called Cross-Border Child Adoption or Inter country Child Adoption. Although inter country adoption can offer a better life for the adopted children, the high number of requests for children to be adopted across country borders can give rise to the commercialization of adoption or even trafficking in persons that can greatly endanger the lives of the adopted children. This raises the question regarding what protection is given by the Indonesian government to avoid the negative impacts of inter country adoption and what challenges are currently faced in providing protection to children who are put up for inter country adoption. Although the legislation regarding adoption, particularly inter country adoption, has undergone a number of improvements, the implementation of such legislation to ensure that the best interests of the children are observed still encounter challenges.
