ABSTRACT
Autonomous Weapon Systems (AWS) have thrown into question the traditional framework for assessing accountability in war. Some scholars ‘scapegoat’ military commanders while others ‘scapegoat’ AWS for violations of International Humanitarian Law (IHL) caused by those systems. This chapter will offer a different approach. Specifically, it posits that designers and programmers should be considered as potentially liable for violations of war crimes committed by their systems.
