ABSTRACT

This conclusion presents some closing thoughts on the concepts covered in the preceding chapters of this book. The book focuses on the development of the notion of peremptory norms of international law, as norms recognized as fundamental by the international community of states as a whole and from which no derogation is permitted unless with the development of a norm of the same character. It begins with an analysis of foreign policies of various states and the impact that fundamental community interests, such as respect for human rights, have on the formulation of such policies. The book demonstrates that the right to solidarity measures is not a new concept in international law. Deals with another challenge concerning the enforcement of general international law and community interests and emerging from the proliferation of lex specialis rules and, particularly, self-contained regimes.
