ABSTRACT

This chapter posits that freedom of expression cannot be limitless. While intangible harms such as psychological harms and sensibility harms cannot be introduced as reasons for limiting expressions, expressions that damage the autonomy, and the physical integrity of the individual could be limited. The chapter defends that these limits should apply in sport with an additional concern in the shape of the safety and security of everyone in the sports venue. The chapter further argues that categorising expressions as political, personal and social is one of the favoured means of limiting political expression. It also takes a critical look at the weighing of interests of individuals, the state and sport associations, emphasising that such a weighing will always favour the latter two. Finally, the chapter analyses an expression’s impact on the flow of play.
