ABSTRACT

This chapter considers regionalism as it has unfolded in Africa, highlighting significant aspects such as the relationship between community and national laws. This serves as a backdrop to the consideration of selected IP frameworks of COMESA, EAC, ECOWAS and SADC and the IP Agenda of the COMESA-EAC-SADC TFTA, with an emphasis on policy guidance on health-related flexibilities and the extent to which it has been translated to, and implemented in, the national sphere.
